FILE AN OPEN RECORDS REQUEST

Beginning June 29, 2021, a public agency must respond to a request to inspect records within five business days.  Please understand that not all public records are available for inspection.  Specifically exempt from production are records of law enforcement agencies compiled in the process of detecting and investigating violations if the disclosure of the information would harm the agency by revealing the identity of informants not otherwise known or by premature release of information to be used in a prospective law enforcement action.  These records may become available after the investigation is complete.  However, records or information compiled and maintained by county attorneys pertaining to criminal investigations or criminal litigation shall be exempt from production and shall remain exempt after enforcement action, including litigation, is completed or a decision is made to take no action.  

Only Kentucky residents may request to inspect public records.  (KRS 61.872 (2) (a)).  You must include a statement in your request that you are a resident of the Commonwealth.   If you are not a Kentucky resident, your request will be denied.

If you want to submit an open records request to this office, you MUST fill out and sign this form (or a form that contains the same information).  You may mail the form to the Nelson County Attorney’s Office, Attn:  Open Records, 602 Bloomfield Road, Bardstown, KY 40004 or you may email the form to acmckay@prosecutors.ky.gov.  You must have the words “Open Records Request” in the subject line of the email.  A signed and dated form MUST be submitted.  If you make the request in the body of the email or in some other unsigned or undated manner, it will be rejected as non-compliant with this agency’s procedures.
